The amended appeal challenged the acquittal of the accused persons, permission to bring forth additional evidence and sought re-trial in the case.

A division bench, comprising Justice B J Sethna and Justice J R Vora, dismissed the amended appeal after concluding the week-long hearing on arguments by Advocate General S N Shelat and defence advocate Sushil Kumar. Friday being the last day before commencement of vacation and as 'the day was practically over', the bench would give the reasons for its decision.

The Citizens for Justice and Peace, a Mumbai-based non-governmental organization, is a party to the case having filed a Special Leave Petition seeking a retrial.
